
MSHSL seeks guidance on how Trump’s executive order affects transgender participation
In a release published Tuesday, the Minnesota State High School League said the recent executive order signed by President Donald Trump regarding transgender athletes features an interpretation of Title IX that “appears to conflict with current state law.”
In accordance with the Minnesota Human Rights Act and the state’s constitution, the MSHSL is subject to state anti-discrimination laws. Those prohibit discrimination based on gender identity. In a message to member schools across the state last week, the MSHSL stated that “therefore, students in Minnesota are allowed to participate consistent with their gender identity.”
But in that same message, the league stated it “will continue to review the existing state laws alongside the new Presidential Executive Order and its timeline, processes for states, and requirements that are included.”
That process is ongoing. The League noted Tuesday that the executive order required a 60-day window for athletic associations to “convene and take action” implementing the order. The MSHSL said it is “considering” a request for a formal opinion from Minnesota Attorney General Keith Ellison for guidance.
Until the issue is resolved one way or another, the current bylaw allowing transgender student participation remains in place.
