DETROIT LAKES — A sentencing date has been set for the Minnesota state senator convicted on burglary charges last week.

Nicole Mitchell, a DFL senator from Woodbury, is due to be sentenced at 10 a.m. Sept. 10 at the Detroit Lakes Courthouse, according to court documents.

A Becker County jury on Friday convicted Mitchell on two felony burglary counts after her April 2024 arrest in her stepmother’s home. During the trial, Mitchell said she entered the house to check on her stepmother, who has Alzheimer’s.

Felony burglary in Minnesota carries a mandatory minimum sentence of at least six months in jail or a county workhouse, and a maximum sentence of 20 years in prison. Felony possession of burglary tools is punishable up to three years in prison.

Mitchell’s legal team announced Monday that she would resign from the state Senate no later than 5 p.m. Aug. 4.
