AG names special investigator into death of Massachusetts State Police recruit

AG Andrea Campbell has appointed a former prosecutor to lead an independent investigation into the death of a state police recruit.

Campbell named David Meier, currently a partner at Todd & Weld LLP, to investigate the death of Enrique Delgado-Garcia.

Delgado-Garcia died at a hospital on Sept. 13, a day after working out in the boxing ring at the Massachusetts State Police Academy in New Braintree, in Worcester County. The State Police, also today, announced the immediate suspension of full contact boxing training for recruits.

“Trooper Delgado-Garcia lost his life while training to protect and serve the Commonwealth, and I want to thank his family and the public for their patience as we sought to identify the most appropriate authority to investigate the facts surrounding his tragic death,” Campbell said. “Today, I am appointing Attorney David Meier to lead that investigation. Mr. Meier has deep experience in death investigations and will ensure independence and integrity in this matter.”

Previous to entering private practice, Meier served as chief of the homicide division in the Suffolk DA’s office.

In 2012-2013, he served as Special Counsel to then Gov. Deval Patrick overseeing the investigation into the Hinton Drug Lab scandal.

“The investigation into Trooper Delgado-Garcia’s death will be undertaken professionally, thoroughly, and responsibly, Meier said in a statement with his appointment. “The Delgado-Garcia family, their community, and the public have been waiting patiently. It is now time to get to work.”

Worcester DA Joseph Early said in an emotional statement last week that his office, which has jurisdiction over Delgado-Garcia’s death, could not lead the investigation because of conflicts of interest.

Early called for a special investigation and and his urging was echoed by numerous other elected officials. On Friday, the Massachusetts ACLU called for a federal investigation.

Delgado-Garcia Worked for the Worcester DA before he signed on the state police.

“Enrique Delgado Garcia was loved by everyone in our office; he’s a dedicated victim witness advocate who joined our office and was with us for about a year and a half before he left our office in April to fulfill a lifetime-long dream of joining the Massachusetts State Police,” Early said last week. “Because of this close relationship, in this matter, there’s no way this office can handle this.”

Delgado-Garcia was wearing boxing gloves and headgear during the boxing training exercise. His manner and cause of death have not been released.  But family members told reporters that he suffered broken teeth and a neck fracture. State police head Col. John Mawn Jr. has ordered a review of the boxing program, which has now been suspended until further notice.

Meier will have independent oversight of the investigation into Delgado-Garcia’s death, the AG’s office said. He’ll have access to resources from the AG’s office and will be able to name his own team of investigators.

“The Massachusetts State Police will have no role in the investigative team or decision-making process,” the AG’s office said in a statement.
