Mexican national who raped girl after state helped him avoid ICE charged with illegal reentry

A Mexican national who reentered the United States illegally after being deported in 2004, and who raped a teenager after Great Barrington Police released him from custody before federal immigration agents could get to him, has been charged with illegal reentry.

The U.S. Attorney’s Office says Eugenio Isidro Victoriano, 54, has been charged with one count of unlawful reentry of a deported alien. Victoriano is currently serving a state prison sentence for rape, indecent assault and battery on a person over 14 years of age and larceny under $1,200. He faces deportation proceedings when he finishes his prison term.

Isidro Victoriano was charged with rape in Dec. 2022 after being arrested for the second time by Great Barrington Police. The Feds say nearly a year earlier, he was arrested by Great Barrington Police for drunken driving, but was released before Immigration and Customs Enforcement (ICE) could take action. Local police released Isidro Victoriano, despite identifying him and his immigration status through fingerprints taken during the arrest.

“In February 2021, Isidro Victoriano was arrested in Great Barrington, Mass., for operating under the influence of alcohol. According to court documents, fingerprints taken during that arrest matched Victoriano’s prior immigration records. Isidro Victoriano was released from state custody before immigration authorities could take action,” the U.S. Attorney’s Office said in a press release.

Isidro Victoriano pleaded guilty to those charges in November 2025 and was sentenced to four to six years in prison, with credit for time served. An immigration detainer was lodged by federal authorities following his arrest.

“Following his November 2025 state conviction, Isidro Victoriano admitted that he was not a U.S. citizen, that he paid a smuggler to enter the United States and that he had no legal authorization to do so,” said the U.S. Attorney’s Office.

Idisro Victoriano was first deported back to his home country of Mexico in April 2004 after he was arrested by U.S. Border Patrol officers near El Paso, Texas, according to court documents. Authorities say sometime later, he snuck back into the U.S.

Isidro Victoriano faces up to two years in prison, one year of supervised release and a fine of $250,000. He is also subject to deportation after completing his federal sentence.

The charge against Isidro Victoriano come amid increased resistance to and legal actions against ICE by politicians in Massachusetts, including an executive order signed by Gov. Maura Healey last week prohibiting the state from entering into any new 287(g) agreements, basically how to deputize local law enforcement “unless there is a public safety need,” and prohibiting ICE from making civil arrests in non-public areas of state facilities.

The governor also filed legislation that would keep ICE out of Massachusetts courthouses, schools, child care programs, hospitals and churches; would make it unlawful for another state to deploy its National Guard in Massachusetts without the governor’s permission; and would allow parents to pre-arrange guardianship for their children in case they are detained or deported.

It also comes after Boston Mayor Michelle Wu signed her own executive order directing Boston Police to de-escalate any potential confrontations between the public and ICE agents in the event of a federal immigration surge, to “keep people safe.”
