State Sen. Nicole Mitchell to resign after burglary conviction

Minnesota state Sen. Nicole Mitchell plans to leave office next month after her conviction last week on two felony burglary charges, her defense attorneys announced Monday.

Mitchell, a first-term Democratic-Farmer-Labor lawmaker from Woodbury, was arrested in April 2024 after breaking into her estranged stepmother’s Detroit Lakes home, reportedly to collect sentimental items belonging to her late father.

Mitchell pleaded not guilty to the charges. Her trial initially was scheduled for January, but a judge granted the defense’s request for a delay, as state lawmakers are exempt from trial while the Legislature is in session.

Senate Republicans called for Mitchell to resign after her arrest and charges, and some DFLers agreed. But many DFL lawmakers said Mitchell should face trial before they considered removing her from office.

Mitchell will resign no later than 5 p.m. Aug. 4, the Ringstrom Dekrey law firm said in a news release. Her departure will leave the Senate with a 33-33 tie between the two parties.
