FedEx firearms thief gets six days in prison

Prosecutors wanted a 10-month sentence for a Middleborough man who stole and sold firearms from FedEx packages he was supposed to be delivering, but Frank O’Toole instead was sentenced to six days.

U.S. Attorney Joshua Levy on Tuesday announced O’Toole’s sentence, which was handed down by U.S. District Court Judge Angel Kelley. O’Toole, 40, pleaded guilty in June 2023 to two counts of possession or sale of a stolen firearm.

O’Toole previously worked as a FedEx delivery truck driver at a facility in Middleborough.

Prosecutors say that between October 2021 and June 2022, he stole three packages which he was responsible for delivering, each containing a firearm – two rifles and a shotgun – intended for a federal firearms licensee. O’Toole then sold the three firearms to an undercover agent during two separate controlled purchases in August 2022, the U.S. attorney’s office said.

Kelley also sentenced O’Toole to three years of supervised release and to complete 250 hours of community service.
